1. Acceptance and eligibility
By accessing or using Fundpaign, you agree to these Terms and the policies linked from them. If you use Fundpaign for an organization, you represent that you are authorized to act for it. You may use the service only if you can form a binding agreement, meet any age requirement applicable to your activity, and are not prohibited from using the service under applicable law. If you do not agree, do not use Fundpaign.
Fundpaign is a technology platform for user-created fundraisers and raffles. Fundpaign does not become the organizer, beneficiary, sponsor, seller, or prize provider merely by hosting a campaign.
2. Accounts and account security
You must provide accurate account information, keep it current, protect your password and verification or reset links, and promptly report suspected unauthorized use. You are responsible for activity conducted through your account. You may not share credentials, impersonate another person or organization, evade a restriction, or create accounts for deceptive purposes.
Organizers must connect and maintain their own eligible Stripe account when payment functionality requires it. Buyers and supporters do not need a Stripe account.
3. Organizer responsibilities
Organizers create and control their campaigns. The organizer—not Fundpaign—is responsible for the campaign’s legality, accuracy, beneficiary authorization, promised use of funds, fulfillment, taxes, reporting, registrations, permits, disclosures, and compliance in every place the campaign is offered or promoted.
Campaign descriptions, images, goals, dates, eligibility terms, prize details, ticket packages, updates, and organizer identity must be complete and truthful. Organizers must communicate material changes and must not misrepresent endorsement, urgency, results, charitable status, or how funds will be used.
Supporters and buyers
Before contributing or purchasing raffle entries, review the campaign, organizer, eligibility rules, dates, refund information, and risks. Do not use someone else’s payment method without authorization, submit false information, manipulate payments or entries, or interfere with campaign or drawing systems. Supporting a campaign involves risk; Fundpaign does not guarantee that a campaign will meet its goal or that an organizer will perform every promise.
4. Payments, fees, and organizer proceeds
Stripe processes payments and connected-account services under its own terms. Fundpaign does not store raw card numbers or card security codes. Stripe may impose identity checks, reserves, holds, processing fees, payout schedules, restrictions, disputes, or other requirements.
Fundpaign charges a 2% platform fee for fundraiser contributions and a 5% platform fee for raffle purchases. Stripe processing fees are separate. The applicable Fundpaign fee is calculated through the payment flow and deducted or collected through Stripe. Organizer proceeds are subject to successful payment, Stripe’s processing, refunds, disputes, reserves, payout availability, and applicable law. A displayed balance or successful charge is not a guarantee that funds are immediately available for payout.
Refunds, chargebacks, and disputes
Refund eligibility is not guaranteed and depends on campaign circumstances, organizer obligations, applicable law, payment-network rules, and the Refund Policy. Stripe and card networks may process or decide disputes and chargebacks. Fundpaign may preserve payment, order, fee, refund, dispute, and audit records after a refund, suspension, or account closure. Organizers may remain responsible for amounts, fees, reversals, or obligations associated with their campaigns where permitted by applicable rules and law.
5. Raffles
Raffles may be regulated or prohibited depending on the organizer, purpose, participants, and jurisdictions involved. Platform access or campaign approval is not legal approval. Organizers must independently confirm legality, publish accurate official rules, own or be authorized to award each prize, enforce age and geographic restrictions, close sales on time, and contact and fulfill winners.
Eligible paid entries are allocated through Fundpaign’s raffle system. After a raffle has ended, Fundpaign’s drawing software permits one permanent cryptographic selection from the locked eligible-entry snapshot. Organizers cannot manually choose a winner or request a generic redraw. Disqualification must have a documented reason, and any replacement follows the stored secure replacement process. 6. Acceptable use and enforcement
You may not use Fundpaign for fraud, misleading content, illegal activity, harassment, infringement, security abuse, prohibited goods or services, payment misuse, drawing manipulation, or other conduct described in the Acceptable Use Policy.
Fundpaign may review, investigate, reject, restrict, suspend, unpublish, or remove campaigns, content, payments access, or accounts when reasonably necessary to enforce policy, address risk, comply with law or provider requirements, or protect users and the service. Where appropriate, Fundpaign may preserve records, cooperate with Stripe, card networks, regulators, or law enforcement, and report suspected serious abuse.
User content and intellectual property
You retain ownership of content you submit. You grant Fundpaign a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content as reasonably necessary to operate, promote, secure, and improve your campaign and the service. You represent that you have the rights and permissions needed for the content you submit. The Fundpaign service, branding, interface, and platform materials remain owned by Fundpaign or its licensors.
7. Service availability and disclaimers
Fundpaign may change, interrupt, maintain, or discontinue features. The service may experience errors, outages, provider interruptions, security events, or circumstances outside Fundpaign’s control. To the extent permitted by law, the service is provided “as is” and “as available,” without promises that every campaign is accurate, lawful, successful, continuously available, or fulfilled.
To the extent permitted by applicable law, Fundpaign will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, campaign failure, organizer conduct, prize non-fulfillment, or third-party services. Any final limitation, exclusion, or monetary cap is subject to applicable law and must be finalized for the jurisdictions in which Fundpaign operates.
Indemnification
To the extent permitted by law, organizers and other users may be required to defend, indemnify, and hold Fundpaign and its personnel harmless from claims, losses, and expenses arising from their campaigns, content, legal violations, taxes, prizes, fulfillment, or breach of these Terms. The final scope and procedure for this obligation are subject to applicable law.
8. Termination and changes
You may stop using Fundpaign at any time. Fundpaign may restrict or terminate access for policy violations, legal or security risk, provider requirements, nonpayment, or discontinuation of the service. Termination does not erase obligations or records that must survive, including financial, raffle, audit, dispute, intellectual-property, and enforcement records.
Fundpaign may update these Terms as the service or law changes. The updated date will be posted here, and material changes may receive additional notice where appropriate. Continued use after an update takes effect means you accept the revised Terms to the extent permitted by law.
